اللـص الفقيـه
حدّث بعض جلساء عبد الملك بن عبد العزيز الماجَشُون، قال:
خرجتُ إلى بستان لي بالغابة. فلما دخلتُ في الصحراء وبعدت عن البيوت، تعرّض لي رجل فقال:
اخلع ثيابك!
فقلت: وما يدعوني إلى خَلْع ثيابي؟
قال: أنا أَوْلى بها منك.
قلت: ومن أين؟
قال: لأني أخوك وأنا عُريان وأنت مكسوّ.
قلت: فأعطيك بعضها.
قال: كلاّ، قد لبستها كلها وأنا أريد أن ألبسها كما لبستها.
قلت: فتعرّيني وتُبدي عورتي؟
قال: لا بأس بذلك، فقد رُوينا عن الإمام مالك أنه قال: لا بأس للرجل أن يغتسل عُريانًا.
قلت: فيلقاني الناس فيرون عورتي؟
قال: لو كان الناسُ يَرونك في هذه الطريق ما عرضتُ لك فيها.
قلت: أراك ظريفًا، فدعني حتى أمضي إلى بستاني وأنزع هذه الثياب فأوجِّه بها إليك.
قال: كلا، أردتَ أن توجِّه إليّ أربعة من عبيدك فيحملوني إلى السلطان فيحبسني ويمزّق جلدي.
قلت: كلا. أحلف لك أيمانًا أني أَفِي لك بما وعدتُك ولا أسوءُك.
قال: كلا، فقد روينا عن الإمام مالك أنه قال: لا تلزمُ الأيمان التي يُحْلَفُ بها لِلّصوص.
قلت: فأحلف أني لا أختل في أَيماني هذه.
قال: هذه يمين مُرَكَّبة على أيمان اللصوص.
قلت: فدع المناظرة بيننا فوالله لأوجّهن إليك هذه الثياب طيّبة بها نفسي.
فأطرق ثم رفع رأسه وقال:
تدري فيم فكرتُ؟
قلت: لا.
قال: تصفّحتُ أمرَ اللصوص من عهد رسول الله صلى الله عليه وسلم إلى وقتنا هذا فلم أجد لصًا أخذ نسيئة. وأنا أكره أن أبتدع في الإسلام بدعة يكون عليّ وِزْرُها ووِزْرُ مَنْ عَمِلَ بها بعدي إلى يوم القيامة. اخلع ثيابك!
فخلعتُها ودفعتُها إليه، فأخذها وانصرف.

The knowledgeable thief (close translation)
One of the speakers in the gathering of Abdul-Malik bin Abdul-Azeez said: "I went out to my farm one day behind the woods. When I reached the desert and I was away from all the houses, a man stopped me. He said: Take off your clothes. I said: Why should I take off my clothes? He said: I deserve them more than you. I said: How is that? He said: Because I am your brother and my clothes are worn out and you have nice clothes. I said: I will give you some. He said: No, you wore it all and I want to wear it all like you did. I said: You want me to be naked and reveal my private parts? He said: There is nothing wrong with that, it was narrated about Imam Malik that he said: There is nothing wrong if a man bathes naked. I said: People will meet me and see me naked. He said: If there are people to see us on this road I wouldn't have stopped you here. I said: you are interesting. Let me go to my farm and take off my clothes and give them to you. He said: No. You want to send me four of you slaves to take me to the Sultan to imprison me and wip me. I said: No. I make an oath to you that I will do what I promise you and I will not harm you. He said: No. It was narrated about Imam Malik that he said: You don't have to fulfil the oath given to thieves. I said: then I will swear to you that I will not break this oath. He said: No, this oath is based upon an oath given to thieves. I said: Please stop this conference between us and I swear by Allah that I will give you these clothes as a gift from the heart. He thought for moment then he said: Do you know what I am thinking of? I said: No. He said: I thought about the theives from the time of the prophet Mohammad, may the peace and mercy of Allah be upon him, until today, and I found no thief that took a gift. And I hate to innovate in Islam a Bid'aa that I will bare its sins and the sins of whoever does it after me until the day of judgement. Take off your clothes. So I took them off and threw them to him. He took them and left.
